General Data Protection Regulation (GDPR)

New laws have been introduced that apply to all organisations in the UK. These laws give people greater say over the way that their personal information (known as data in this legislation) is stored and used. Brunswick Baptist Church, Gloucester, has to define how it uses such data so that people can decide whether to consent to the Church using their data. This document also states their legal rights under the legislation, which is called the General Data Protection Regulation.

Religious belief is considered to be sensitive data in this legislation, therefore we have to seek each person’s consent, including children, before we can use their personal data because their religious beliefs could be implied from the information that we hold. Each person who signs a form consenting to the church processing and storing their personal data should read this document.

Your personal data – what is it?

Personal data relates to a living individual who can be identified from that data e.g. your name or mobile phone number. Identification can be by the information alone or in conjunction with any other information in the data controller’s possession or likely to come into such possession. The processing of personal data is governed by the General Data Protection Regulation 2016/679.

Who are we?

The minister and trustees/deacons of Brunswick Baptist Church, Gloucester are the data controller (see Contact Details below for how you may contact them). This means they decide how your personal data is processed and for what purposes. For the purposes of this document, where you see Brunswick Baptist Church, Gloucester, this will be taken to mean the minister and trustees/deacons of Brunswick Baptist Church, Gloucester.

How do we process your personal data?

Brunswick Baptist Church, Gloucester complies with its obligations under the GDPR by keeping personal data up to date; by storing and destroying it securely (for example, by burning or shredding the documents on which the personal data is stored); by not collecting or retaining excessive amounts of data; by protecting personal data from loss, misuse, unauthorised access and disclosure and by ensuring that appropriate technical measures are in place to protect personal data.

We use your personal data for the following purposes: 

  • To provide ministerial care for our members and others who attend the church;

  • To administer membership records;

  • To administer Gift Aid;

  • ·To manage our own employees and volunteers;

  • ·To maintain our own accounts and records;

  • To keep members and others up to date with prayer requests and other news, events, activities or services running at Brunswick Baptist Church, Gloucester;

  • To operate and maintain the Brunswick Baptist Church, Gloucester website, including recorded Sunday sermons, and to respond to any needs that might arise as a result of an individual contacting the Church;

  • To keep members and others up to date with events of interest to Christians in the Gloucester area;

  • To maintain various rotas and inform the volunteers about their duties via a printed copy that is distributed to all on that rota, the exception being the Flower Rota that is displayed on a noticeboard. In addition, rota volunteers are shown on the weekly newssheet and the monthly overview of the services that are distributed to all church attenders. Wherever possible, only the volunteer’s Christian name is used;

  • In the case of minors, to decide which group is best suited for their age;

  • To notify the responsible person of any incidents that may have occurred to minors or adults lacking the mental capacity to determine their personal data uses for themselves.

What is the legal basis for processing your personal data?

Article 6 – Lawfulness of processing

  • Consent of the data subject;

  • Processing is necessary for the performance of a contract with the data subject or to take steps to enter into a contract; for example acting as guarantor for a rental agreement;

Article 9 – Processing of special categories of data

  • Explicit consent of the data subject;

  • Processing is necessary for carrying out obligations under employment, social security or social protection law, or a collective agreement;

  • Processing is necessary to protect the vital interests of a data subject or another individual where the data subject is physically or legally incapable of giving consent;

  • Processing is carried out by a not-for-profit body with a political, philosophical, religious or trade union aim provided:-

    • ∙the processing relates only to members or former members (or those who have regular contact with it in connection with those purposes); and

    • there is no disclosure to a third party without consent.

  • Processing is necessary for archiving purposes in the public interest, or scientific and historical research purposes or statistical purposes.

Sharing your personal data

Your personal data will be treated as strictly confidential, and will be shared only with the minister, deacons and group leaders. Your data will only be shared with third parties outside of the church with your consent, unless we are legally obliged to do so.

How long do we keep your personal data?

We keep your personal data for no longer than reasonably necessary; that is whilst you continue to be a member or whilst you are attending the church. If there are safeguarding issues, we are obliged to keep this information until any legal processes have been completed.

Your rights and your personal data

Unless subject to an exemption under the GDPR, you have the following rights with respect to your personal data:-

  • The right to request a copy of your personal data which Brunswick Baptist Church, Gloucester holds about you;

  • The right to request that the data controller corrects any personal data if it is found to be inaccurate or out of date;

  • The right to request your personal data is erased where it is no longer necessary for the data controller to retain such data;

  • The right to withdraw your consent to the processing at any time;

  • The right to request that the data controller provide the data subject with his/her personal data and where possible, to transmit that data directly to another data controller, (known as the right to data portability), (where applicable);

  • The right, where there is a dispute in relation to the accuracy or processing of your personal data, to request a restriction is placed on further processing;

  • The right to object to the processing of personal data, (where applicable)

  • The right to lodge a complaint with the Information Commissioners Office.

Automated Decision Making

Brunswick Baptist Church, Gloucester does not carry out any automated decision making processes.

Further processing

If we wish to use your personal data for a new purpose, not covered by this Data Protection Notice, then we will provide you with a new notice explaining this new use prior to commencing the processing and setting out the relevant purposes and processing conditions. Where and whenever necessary, we will seek your prior consent to the new processing.
